1. INTRODUCTION

UxNitro group entity, the details of which are indicated in the UxNitro’s Terms of Service, (“UxNitro“) provides you web hosting, domain name registration, and related products and service.

UxNitro group entity, the details of UxNitro seeks to ensure the highest level of data privacy when offering its variety of quality products and services to UxNitro customers and subscribers (“Subscribers“) (collectively, “You”, or “Users“).

At UxNitro, the privacy and security of our Users is of paramount importance. UxNitro is committed to protecting the data you share with us.

When this Policy mentions “UxNitro“, “we,” “us“, or “our“, it refers to UxNitro that is responsible for protection of your personal information in line with this Privacy Policy (“Data Controller“).

This Privacy Policy (“Policy“) explains how UxNitro processes information that can be used to directly or indirectly identify an individual (“Personal Data“) collected on our Site, our services (“Service”), forums and our mobile applications (“Platform“).

UxNitro shall process all Personal Data adhering to the general data processing principles:

  • collect and process Personal Data only for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes (purpose limitation);
  • ensure that Personal Data is adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (data minimization);
  • ensure that Personal Data is accurate and, where necessary, kept up to date (accuracy);
  • ensure that Personal Data is kept in a form that permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed (storage limitation);
  • process Personal Data in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures (integrity and confidentiality).

All and any information stored on UxNitro’s Platform is treated as strictly confidential. All information is stored securely and is accessed by qualified and authorized personnel only.

3. INFORMATION WE COLLECT

3.1. Information You provide to us.

Information that is necessary for the use of the UxNitro Platform

We ask for and collect the following personal information about you when you use the UxNitro Platform. This information is necessary for the adequate performance of the contractual arrangement which is in place between you and us and to allow us to comply with our legal obligations. Failing to provide any of this data or decision to delete or object to the processing of any of such data may result in de-activation of your UxNitro Account.

  • Account Signup Information. When you sign up to UxNitro, we require you to provide minimum information – email address and password. In some particular cases we ask you to provide more information – such as your first and last name, identity verification, contact details. Such information is required when you are applying for a registration of domain name and indicated as the WHOIS information.
  • Login information. We collect Login scope and Email scope from Google, please see https://developers.google.com/identity/protocols/oauth2/scopes?hl=en and email from Facebook.
  • Identity Verification. To comply with the rules set forth by the Internet Corporation for Assigned Names and Numbers (“ICANN“) before the registration of the new domain name, UxNitro may collect identity verification information (such as images of your passport, national ID card, valid driving license or other documents as required or permitted by applicable laws).
  • Payment Information. To order and use features of the UxNitro Platform (such as web-hosting, domain name registration), we may require you to provide certain financial information in order to facilitate the processing of payments. We use 3rd party (payment processor) services, so we do not collect and store credit card information (we receive information about the payment status and store only last 4 credit card digits).
  • Communications, Chats, Messaging. When you communicate with UxNitro (using general inquiries window), we collect information about your communication and any information you choose to provide or disclose. In order to respond to your request, we may access information provided in your UxNitro Account, purchase history, etc.
  • Visitors and users of our User’s websites or services. We may also collect information pertaining to visitors and users of our User’s websites or services (“Users-of-Users”), solely for and on our Users’ behalf.

You may also choose to provide us information when you fill in a form, conduct a search, update or add information to your UxNitro Account, respond to surveys, post to community forums, participate in promotions, or use other features of the UxNitro Platform. We advise against posting any information you don’t wish to make public on the UxNitro Platform. If you upload any content to your account or post it on your Website and provide it in any other way as part of the use of any Service, you do so at your own risk.

UxNitro processes the information you provide to us on the legal basis of:

  • Your consent, expressed when voluntarily submitting and filling your Personal Data details in sign-up forms, by e-mail, request or inquiries window, etc.; and
  • Conclusion and performance of contractual arrangements and obligations between UxNitro and the User;
  • Pursuance of legitimate interests of UxNitro, as Data Controller and manager of UxNitro platform;

Disclaimer

Please always take care and observe at least the following minimum requirements for the protection of your personal information:

  • please omit using your name, address, telephone number, e-mail, personal identification number, date of birth, bank Account number, card number, other special (sensitive) data, etc. in the subject of the request or file name;
  • please omit using your personal code, payment card number, and other financial information and details, health, family member details, or other specific (sensitive) data, in the texts of requests, e-mails or similar communication to us, and
  • please make sure that the remaining personal data is only indicated to the extent necessary for the purposes for which the letter, request or inquiry is sent.

Right to delete your data

You may at any time access and edit, update or delete your contact details by logging into your UxNitro’s platform Account.

Please note that you will only be able to delete your email during de-activation of your UxNitro Account. To deactivate your Account, please send your request to [email protected], and you will be provided with further guidance.

3.2. Information We Collect when You Use the Platform

When you use the UxNitro Platform or contact us directly by any communication channel, we may collect information, including personal information, about the services you use and how you use them.

This information is necessary for the adequate performance of the contract between you and us, to enable us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionalities of the UxNitro Platform.

Automatic collection of data

  • Log data and Device information. We automatically collect log data and device information when you access and use the UxNitro Platform, even if you have not created an UxNitro Account or logged in. That information includes, among other things: Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp and/or clickstream data.
  • Tracking technologies and Cookies. We use cookies, beacons, tags, scripts and other similar technologies, such as CI codes (click tracking), ISC (source tracking), and ITC (item tracking codes). We also automatically collect information about device’s operating system, phone model, device ID and customer number.   • Usage information. We use a tool called “Google Analytics” to collect information about your interactions with the UxNitro Platform (what pages you visit, such as the pages or content you view, your searches for Listings, bookings you have made, and other actions on the UxNitro Platform. In consequence, Google, Inc. plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site). For more information please visit Google.
  • Geo-location data. We collect information about your approximate location as determined by data such as your IP address to offer you an improved user experience and comply with applicable legal requirements, such as taxes, pricing, etc. Such data may be collected only when you access UxNitro platform using your device.

UxNitro processes this information on the legal basis of:

  • Your consent;
  • Conclusion and performance of contractual arrangements and obligations between UxNitro and the User;
  • Pursuance of legitimate interests of UxNitro, as Data Controller and manager of UxNitro platform.

4. HOW WE USE YOUR DATA?

We use, store, combine and process information, including personal information, about you to provide, understand, improve, and develop the UxNitro Platform, create and maintain a trusted and safer environment and comply with our legal obligations.

  • To Identify. Personal identification information is collected and processed for the purposes of User identification as well use of services and domain name registration. Additionally, this information may be used to provide Users with support, letting them know about upcoming updates or improvements, providing information regarding changes of any Terms of Use (including changes to this Policy) as well as other important information.
  • To Create and Maintain Trusted Environment. We verify or authenticate information or identifications provided by you (such as ID number, email or phone numbers). We also use collected information to detect and prevent fraud, spam, abuse, security incidents, and other illegal and harmful activities.
  • To Create Aggregated Statistical Data, to Carry out Market Research and Analysis necessary for running out our business, to improve our services we use aggregated and/or inferred non-personal information enabling us to evaluate our customers’ needs, sales and other trends of our activities.
  • To Stay Connected. We use information about data usage, devices, operating systems to diagnose problems with our servers, to administer our Platform, adopt decision when to retire SDK’s/OS versions, to identify characteristics of major users so that we may optimize our applications and services and make your browsing and purchasing experience more enjoyable.
  • To Customize Marketing. To provide more customized offers to our Users, we may conduct data analysis based on information you provide to us, your interactions with the UxNitro Platform and its Users.
  • To Send Service and Billing Messages. UxNitro may also contact you with important information regarding our Services, or your use thereof. For example, we may send you a notice (through any of the communication channels available to us) if a certain Service is temporarily suspended for maintenance; reply to your support ticket or e-mail; send you reminders or warnings regarding upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints regarding your hosting plan; or notify you of material changes in our Services. Such kind of communication is essential, for this reason, no opt-out possibilities are given to avoid receiving such Service and Billing Messages unless you are no longer a UxNitro User (which can be done by deactivating your Account).
  • To Register Domain. In certain jurisdictions or pursuant to the rules of the ICANN or certain registries, domain name registration information has to be made available and accessible to the public through a “WHOIS” search. The WHOIS database is a publicly accessible database that lists the domain name registration information for a particular domain name, the name server(s) to which the domain name points, and the domain name’s creation and expiration date. The domain name registration information you provide is stored by UxNitro and is made available to the public through WHOIS searches. UxNitro may deposit your domain name registration information with a third-party escrow provider to comply with ICANN requirements. At times, Users may receive solicitations that result from searches of the publicly available WHOIS database by other companies or individuals. Any such solicitations or e-mail communications do not come from UxNitro and UxNitro is not responsible for the use of WHOIS information by third parties.   • To contact you. In order to notify you regarding your Account, to troubleshoot problems with your Account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes, we may contact you via email, telephone, text messages, and portal.
  • To get feedback. We may contact you via email to invite you to review any services and/or products you received from us in order to collect your feedback and improve our services. We might use an external company, to collect your feedback which means that we will share your name, email address and reference number for this purpose.
  • To provide, operate and improve the Services.
  • To enhance data security and to prevent fraud.
  • To comply with applicable laws and regulations.

5. JOB APPLICATIONS

UxNitro welcomes all qualified Applicants to apply to any of the open positions published at https://UxNitro.com/career, by sending us their contact details and CV (“Applicants Information“) via the relevant Position Application Form on our Website, or through any other means provided by us.

We understand that privacy and discreteness are crucial to our Applicants and are committed to keep Applicants Information private and use it solely for UxNitro’s internal and group companies recruitment purposes (including for identifying Applicants, evaluating their applications, making hiring and employment decisions, and contacting Applicants by phone or in writing).

UxNitro may retain Applicants Information submitted to it for no longer than one year after the applied position has been filled or closed. We collect this information to re-consider Applicants for other positions and opportunities at UxNitro; we can use their Applicants Information as reference for future applications submitted by them; and if the Applicant is hired, for additional employment and business purposes related to his/her work at TunlGuard.

If you previously submitted your Applicants Information to UxNitro, but now wish to access it, update it or have it deleted from our systems, please contact us at [email protected] .

 

6. INFORMATION PERTAINING TO VISITORS AND USERS OF OUR USER’S WEBSITES OR SERVICES 

We may collect, store and process certain information pertaining to visitors and users of our User’s websites or services, solely on our Users’ behalf and at their direction. Each of our Users is able to collect and manage information, including personal data, via their website. Such information and personal data are then stored with UxNitro. For such purposes, within the meaning of the GDPR, UxNitro may in certain limited cases, as specified in the Terms of Service, be considered as a “data processor” of such information pertaining to visitors and users of their websites or services. The Users controlling and operating such User websites, shall be considered as the “data controllers” of such information, and shall be solely, completely and fully responsible and liable for complying with all laws and regulations that may apply to the collection and control thereof, including all privacy and data protection laws of all relevant jurisdictions.

User shall be solely, completely and fully responsible for the security, integrity and authorized usage of information related to visitors and users of their websites or services, and for obtaining consents, permissions and providing any fair processing notices required for the collection and usage of such information.

UxNitro has no direct relationship with the individual visitors and users of our User’s websites or services whose personal data it processes. If you are a customer of any of our Users, and would like to make any requests regarding your personal data, please contact such User(s) directly.

7. DIRECT MARKETING AND SERVICE EXPIRATION NOTICES/RENEWAL REMINDERS

When creating an Account at our Platform, subject to the available preferences, you are free to give consent and/or opt-out from receiving various offers and/or notices directly to your e-mail, phone (SMS and/or Whatsapp messages) or in your Account. We use provided contact details and your preferences for direct marketing (by sending various offers or newsletters) and/or Service expiration notices / renewal reminders.

This communication, depending on your preferences, may be personalized taking into account any other information which you have provided to us (e.g. location, social media profile information, purchase history etc.) or we have collected or generated from other sources as described below.

Please note that in case you subscribe to service expiration notices / renewal reminders via SMS/WhatsApp, it is our right, but not an obligation, to send such notices / reminders for each Service.

Right to object / revoke consent 

If a User wishes to change their preferences communication (revoke consent or object), they are free to exercise such option at any time they wish by (1) following the instructions to unsubscribe in the received email (usually, by clicking on a link for that purpose at the bottom of our e-mail) / text message; (2) visiting and adjusting User’s personal account settings (communication preferences).

8. OTHER USES OF YOUR PERSONAL DATA

  • Developing Platform. We use data, including public feedback, to conduct research and development for the further development of our platform in order to provide you and others with a better, more intuitive and personalized experience, drive membership growth.
  • Customer Support. We use data to help you and fix problems. We use the data (which can include your communications) to investigate, respond to and resolve complaints and issues (e.g., bugs).
  • Aggregate Insights. We use data to generate aggregate insights. We use your data to produce and share aggregated insights that do not identify you.
  • Security and Investigations. We use data for security, fraud prevention and investigations. We use your data (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations of our Terms of User or this Policy and/or attempts to harm our Users.

9. SOURCES OF PERSONAL DATA

We collect and receive your Personal data from yourself (including your device) as well as from the following sources:

  • Social network operators (such as Facebook, Google, etc.);
  • Third-party service providers, suppliers and our partners;
  • Other legal sources.

10. RETENTION AND DELETION

We generally retain your personal information for as long as is necessary to provide our services and to comply with our legal obligations. Where your personal information is no longer required we will ensure it is securely deleted.

If you would like to stop us using your personal information, you shall request that we erase your personal information and close your UxNitro Account.

After de-activation of Account, we will still retain the following data for the purposes of compliance with applicable legal requirements (such as tax, accounting, legal reporting, AML, other), for as long as we are legally required by virtue of such legal requirements:

  • profile with de-personalised information (we will change your email into [email protected], erase you name, surname and contact information) like purchased services, login information, payment information, etc.

Please also note that we may further retain some of your personal information in such cases (i.e., after closure of your UxNitro Account):

  • as long as it is necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety. If UxNitro suspends your UxNitro Account for safety reasons, we may retain certain information from that UxNitro Account to prevent that User from opening a new UxNitro Account in the future;
  • the extent necessary to comply with our legal obligations. UxNitro may keep some of your information for tax, legal reporting and auditing obligations;
  • forum posts or other publicly visible information may continue to be publicly available on the UxNitro Platform, even after your UxNitro Account is deactivated. However, attribution of such information to you will be removed. Additionally, some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers;
  • to resolve disputes;
  • to enforce our agreements and/or pursue or protect our legitimate interests;
  • as we protect UxNitro Platform from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time;
  • domain name registration data – at the moment of writing this Policy, in order to register domain, we are requested to provide personal information about the owner of domain; this information is shown in WHOIS directory and is public. 11. DATA TRANSFERS AND USE OF THIRD-PARTY SERVICES

While collecting and processing your Personal Data, we may perform data transfers to various third parties.

11.1. With your consent

We will share your Personal Data with companies, organizations or individuals outside our group of companies when we have your consent to do so.

11.2. Where do we process your personal data?

  • Users’ Personal Information may be maintained, processed and stored by UxNitro and our authorized affiliates and service providers in the United States, and in other jurisdictions as necessary for the proper delivery of our Services and/or as may be required by law (as further explained below).
  • Job Applicants Information will be maintained, processed and stored in Lithuania, in the applied position’s location(s), and as necessary, in secured cloud storage provided by our Third-Party Services.
  • UxNitro affiliates and service providers (such as third-party data centres, servers, website design, administration services, online traffic and website analysis, statistics, direct marketing services, mailers, messengers, etc.), that store or process your personal data as well as personal data of your users on UxNitro’s behalf are each contractually committed to keep it protected and secured, in accordance with industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction (see below).

We may share non-personally identifiable information publicly as well as with our partners – publishers, advertisers. For example, we may share information publicly to show trends about the general use of our platform.

If we are involved in a merger, reorganization, acquisition or sale, we will continue to ensure the confidentiality of any Personal Data and give all affected Users appropriate notices.

Standard contractual clauses for data transfers outside the EU or EEA. Your personal data as well as personal data of your users might be transferred to processors, sub-processors or other data recipients established in third countries (i.e., data centers and servers, located outside EU or EEA, please see more here). For such transfers to be compatible with the requirements of GDPR, we have concluded with the data processors and/or sub-processor relevant agreements on such data transfers outside EU or EEA, which comply with the European Commission approved standard contractual clauses for data transfers from data controllers in the EU to data processors and/or controllers established outside the EU or European Economic Area (EEA). Other grounds for data transfers outside the EU or European Economic Area (EEA). Your personal data as well as personal data of your users might be transferred to data recipients established in third countries on other legal grounds compatible with the requirements of GDPR (Art. 45-49).

Transfer, disclosure of data to competent authorities.  In certain situations, UxNitro may be asked to disclose personal data in response to lawful requests by public authorities, other competent authorities, including when it is required to meet national security or law enforcement requirements, and will do so where permitted by local data protection laws.

11.3. Data Localisation Obligations

If you reside in a jurisdiction that imposes “data localisation” or “data residency” obligations (i.e., requiring that Personal Information of its residents be kept within the territorial boundaries of such jurisdiction), and this fact comes to our attention, we may maintain your Personal Information within such territorial boundaries, if we are legally obligated to do so.

You acknowledge that while doing so, we may continue to collect, store and use your Personal Information elsewhere.

11.4. Targeting, advertising

We also use Facebook, Google, as well as other advertising and marketing tools. You should carefully read the privacy policy of these service providers. 11.5. Social Media Features

Our Services include certain Social Media features and widgets, single sign on features, such as the “Facebook Connect” or “Google Sign-in”, the “Facebook Like” button, the “Share this” button or other interactive mini-programs (“Social Media Features”). These Social Media Features may collect information such as your IP address or which page you are visiting on our Website, and may set a cookie to enable them to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your interactions with these third parties’ Social Media Features are governed by their respective policies.

11.6. Our Legal Obligation to Use or Disclose Personal Data

We will reveal your Personal Data to state and public authorities without your prior permission only when we are legally required to provide information, including taking legal action to defend our rights, as well as the cases, where we have a belief in good faith that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable law, regulation, legal process or enforceable governmental request, enforce applicable Terms of Services, including investigation of potential violations, detect, prevent or otherwise address fraud, security or technical issues.

UxNitro has implemented security measures designed to protect the Personal Information you share with us, including physical, electronic and procedural measures. Among other things, we offer HTTPS secure access to most areas on our Services. We also regularly monitor our systems for possible vulnerabilities and attacks, and regularly seek new ways and Third-Party Services for further enhancing the security of our Services and protection of our Visitors’ and Users’ privacy.

Regardless of the measures and efforts taken by UxNitro, we cannot and do not guarantee the absolute protection and security of your Personal Information, or any other User Content you upload, publish or otherwise share with UxNitro or anyone else.

We therefore encourage you to set strong passwords for your User Account and avoid providing us or anyone with any sensitive information of which you believe its disclosure could cause you substantial or irreparable harm.

  • the right to erase any data concerning you. Users may demand erasure of data without undue delay for legitimate reasons, e.g. where data is no longer necessary for the purposes it was collected, or where the data has been unlawfully processed;
  • the right to the restriction of data processing. Users, for legitimate purposes, may obtain restrictions of data processing from the controller;
  • the right to object to the processing of Personal Data when processing is carried out on the basis of legitimate interest, as well as in cases of use of your personal data for direct marketing purposes, as specified above in this Policy.

This Privacy Policy (the “Policy”, the “Privacy Policy”) applies to the processing of personal data by Quickship LLC., registered and existing under the laws of Delaware, USA, with registered address: 700 N. Fairfax St, Suite 614, Alexandria 22314 VA, USA (“UxNitro”, “we”, “us” and “our”) in its capacity as a data controller of personal data.

The Policy explains our data privacy practices in regard to the processing of personal data of individuals (“data subjects”, “you”, “your”) who visit our website (the “Site“) and/or use the services and/or products ordered or accessed through the Site (the “Services”). For the avoidance of doubt, this Policy does not apply to the processing of your personal data by third parties whose websites are not owned and operated by us.

b. Types of personal data: 

  • Contact information – We may collect personal data such as first and last name, email address, and other contact and personal information when you sign up for our newsletter, register and get access to a demo version of our Site Tools, download materials from our Site, such as e-books, communicate, comment, review and/or discuss topics in the sections provided for this on our Site.
  • Personal data, contained in log files – When you visit our Site we may process information such as your IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. 
  • Personal data collected through website analytics tools – We may collect information about your use of our Site, such as number of visits, pages visited, popularity of certain content.   • Customer account information – We process personal information such as first and last name, name of the legal entity and its legal representative, address, phone number, email address, language preferences, IP address, payment and billing information (i.e. credit card information and/or PayPal account, personal or TAX identification number etc.), so you can place orders, request information, get support and use the Services. You may also opt to provide information about your Facebook and/or Twitter accounts. 
  • Personal data, contained in log files – When a Customer visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. 
  • Personal data collected through website analytics tools – We may collect information about the Customer’s use of our Site, such as number of visits, pages visited, the popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise the device used and compile the information. They collect information such as what pages the Customer visits and how much time the Customer spends on these pages, the IP address assigned to the Customer, what operating system and web browser the Customer uses, and what site the Customer visited prior to visiting our Site. 
  • Other types of personal data – When the Customer contacts us, including via any of our support channels, we may process the personal data provided to us (including voice) in order to deal with the Customer’s query. In addition, if the Customer loses access to its account, we may request certain documents in order to verify its identity. Those documents may contain personal data such as name, address, nationality, date of birth, identification document number, etc. In addition, when you purchase a SSL certificate for your website, hosted with us, we store its key in order for the certificate to operate properly. 
  1. Users

a. Definition: Individuals who access and/or administer any of the Services for our Customers.

b. Types of personal data:  

  • User information – We may process personal information such as first and last name, address, phone number, email address, so you can access and/or administer the Services, request information, and get support. 

  • Personal data, contained in log files – When a User visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. 
  • Personal data collected through website analytics tools – We may collect information about User’s use of our Site, such as number of visits, pages visited, and popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognize the device used and compile the information. a. Definition: Owners of domain names, registered with us.

  • Domain name ownership information – We process personal data such as first and last name, name of the legal entity and its legal representative, address, phone number and email address of the Registrants, as well as the domain name and its status, name server, IP address etc.

  1. End Users

a. Definition: Persons who visit, access, use and/or interact with our Customers’ websites.

b. Types of personal data: 

  • Personal data, contained in log files – When an End User visits our Customer’s website we process End User’s information such as IP address, domain name, date, request method, URI user agent, referrer, TLS version, cache data.

  1. Affiliates

a. Definition: Persons who participate in our Affiliate Program.

b. Types of personal data: 

  • Affiliate account information – We process personal information such as first and last name, name of the legal entity and its legal representative, address, phone number, email address, IP address, payment information (i.e. PayPal account and/or bank account information, personal or TAX identification number etc.). 
  • Personal data, contained in log files – When an Affiliate visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. 
  • Personal data collected through website analytics tools – We may collect information about Affiliate’s use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise the device used and compile the information. They collect information such as what pages the Affiliate visits and how much time the Affiliate spends on these pages, the IP address assigned to the Affiliate, what operating system and web browser the Affiliate uses, and what site the Affiliate visited prior to visiting our Site. 
  • Other types of personal data – When the Affiliate contacts us, including via any of our support channels, we may process the personal data provided to us in order to deal with the Affiliate’s query. In addition, if the Affiliate loses access to its account, we may request certain documents in order to verify its identity. Those documents may contain personal data such as name, address, nationality, date of birth, identification document number etc.
  1. Participants in events/promotions

a. Definition: Individuals, who participate in raffles, surveys and/or register to attend events, webinars and other promotions (co) organized and/or sponsored by us or any of the companies part of UxNitro Group. 

b. Types of personal data: 

  • Contact information – We may process Participant’s data such as first and last name, email address, address, phone number, social media username, etc. 
  • Other types of personal data – We may process your image and voice, if the event/promotion is being recorded. In case the promotions take place on our Site, when you visit it we may process information such as your IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. We may also collect information about your use of our Site, such as number of visits, pages visited, and popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognize your device and compile information about you. They collect information such as what pages you visit and how much time you spend on these pages, the IP address assigned to you, what operating system and web browser you use, and what site you visited prior to visiting our Site.

a. Definition: Individuals, who may not fall under the scope of the definitions listed above, such as potential customers, third parties, part of ownership account disputes, complainants, followers in our social media channels, etc.

  • Contact information – We may process information such as first and last name, name of the legal entity and its legal representative, email address, address, phone number,  social media username, etc.
  • Other types of personal data – We may process your voice, if you contact us by phone, and/or your image, in case you share such data with us. We may process any other types of personal data provided to us in order to deal with your query.

II. Sources of data collection

Apart from you, being the main source of information we collect about you, we may also collect information from publicly accessible sources (e.g. companies trade register, WHOIS, local national list(s) of sanctioned persons) and/or third parties, such as our affiliates, trusted partners, including but not limited to marketing, advertising, security service providers, etc.

III. Purposes of and legal basis for data processing 

We strive to collect only the minimum personal data necessary for the completion of the purposes of data processing, as set out below:

  • To provide, maintain and secure the Services (including our network, information systems and the server infrastructure operated by us) and fulfil our obligations under the applicable agreements and terms, including to administer any promotions (co) organized and/or sponsored by us or any of the companies part of UxNitro Group. In such cases the legal basis for the data processing is the performance of a contract and compliance with a legal obligation.
  • To maintain and secure our Site, network, information systems and the server infrastructure operated by us, including but not limited to investigating and preventing fraudulent transactions, unauthorized access to the Services and other illegal activities, to address any queries, to enforce our terms, to defend against claims and protect the rights, property or safety of UxNitro, to improve and/or develop the Services for the benefit of our Customers, and for statistical purposes. In such cases the legal basis for the data processing is our legitimate interest.
  • To promote our brand and Services, including to send marketing communication, newsletters, surveys, monitor and analyze activities for advertising purposes etc. In such cases the legal basis for the data processing is your consent. 
  • To fulfil our legal obligations, such as compliance with court orders, orders/requests or other documents issued by competent authorities, applicable legislation, etc. In such cases the legal basis for the data processing is the compliance with a legal obligation to which we are subject. 
  • For other purposes which may not fall under the scope of the above-mentioned purposes we will obtain your consent.   

IV. Cookies, beacons, tags, pixels

We use cookies to collect some of the information set out in this Policy. Cookies can store your account identifier, ordering status, personalization or website tracking. They can also be used for technical purposes such as keeping track of your current shopping session and enabling you to proceed to checkout and pay for your according order or to save information that has already been entered (languages preference, and your region), so that we can offer improved and more personalized Services, products and other relevant communication tailored to you. Cookies also allow us to fulfill our contractual obligations to third parties and partners if you have made a purchase on our Site by following a link from theirs. 

We also use remarketing pixels provided by third parties to collect the information that you have visited our Site and were interested in certain offers.  

We also use beacons, tags, click tracking codes, and scripts to analyze trends and movements of users around the Site, gather information about the user base as a whole and how we can improve the Services and Site, to provide advertising based upon activities and interests and to measure advertising effectiveness. As a result, we may display targeted, or interest-based, offers to you based on the products you currently own or have recently viewed and deliver other communication more relevant to you and your interests outside of our Site, on other websites part of the third party’s network.

V. Sharing of personal data

We disclose entire or part of your personal data in the following circumstances and always ensure that the appropriate safeguards on your privacy are undertaken:

  1. To provide the Services and run our business – We may engage third-party service providers in the delivery of the Services and also for administrative, billing, tax and all other purposes related to the management of your account and our operations. In such cases your personal data may be shared with companies part of UxNitro Group, business partners, independent contractors, external consultants, auditors, collaborators, etc. Those third-party service providers include companies that operate in different industries such as fraud detection, technology service, internet information providers, payments and data processors, couriers, providers from the finance, media, internet content and information industries, advertising and marketing, technologies, analytics, etc. and that may be located worldwide (including but not limited to the EU, EEA, Switzerland, UK, USA, Australia, Singapore, Japan, etc.). 

  2. To comply with the applicable legislation and to exercise rights – We may share personal data with companies, organizations or individuals when we believe in good faith that access, use, preservation or disclosure of such data is necessary to meet any applicable law, comply with regulations, legal procedures, enforceable requests and/or competent authority requirements; to enforce our terms, defend against claims and protect the rights, property or safety of UxNitro, our Customers and/or the public as required and/or permitted by law.

  3. To comply with ICANN’s and ICANN-accredited registrar providers’ rules, regulations and policies – UxNitro, in its capacity as a reseller of domain names, shares Registrant’s data for the purposes of domain name registration and/or to comply with the applicable rules, regulations and policies of ICANN and the relevant registrar providers (such as TuCows (OpenSRS), ENOM, Openprovider, etc.).

  4. In case of business reorganization, transfers, and/or acquisitions – We may share your information to third parties in connection with any prospective or completed business reorganization, merger, sale of company assets, or acquisition of all or a portion of our business by another entity, or in the unlikely event that UxNitro goes out of business or enters bankruptcy. If any of these events happen, we may take any reasonable steps to notify you and this Policy would continue to apply to your personal data processing.

  5. To comply with your instructions – We may share your information with third parties with your explicit consent or at your direction. We will not, however, sell, rent, share or otherwise disclose personal data for commercial purposes in any way that is contrary to the commitments made in this Policy. 

  6. We also may share data with Google whose invisible reCaptcha service we use to protect our website from malicious activity. Use of the invisible reCaptcha is subject to Google’s Privacy Policy and Terms of Service.

VI. International data transfers

In the course of our business operations and for the delivery of the Services we may transfer personal data around the world (including but not limited to the EU/EEA, UK, Australia, Singapore, Japan) where we and/or the third parties, specified in Section III above, use data centers, facilities and/or maintain data processing operations.  

In the event that we receive personal data of data subjects from the EU/EEA and/or the UK, and in cases where we transfer such personal data received to other countries which are not considered to provide an adequate level of data protection, we will ensure that:

  • we have provided appropriate and proportional technical and organizational data protection and cybersecurity risk mitigation measures, as well as we have performed the appropriate risk assessments; 
  • we have provided appropriate safeguards to protect the personal data by virtue of making available the Standard Contractual Clauses, approved by the European Commission (when the data subject is located in the EU/EEA) or the International Data Transfer Agreement, issued by the competent authority in the UK (when the data subject is located in the UK), as transfer mechanisms. 

We also comply with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. Quickship LLC. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. 

VII. Security measures

We use Secure Sockets Layer (SSL) protocol to encrypt the information you enter on our Site in order to protect its security during transmission to and from our Site. When storing information, we protect its security by encrypting critical data. Access to this information is severely restricted, logged and reviewed periodically. When we collect credit card data and payments (we do not store full credit card numbers and CVV codes), the credit card data is subject to tokenization and strong security measures applied by our payment processors in accordance with the PCI DSS requirements.

We maintain physical, logical, electronic and procedural safeguards when collecting, storing and disclosing personal data. Our security procedures require us in some cases to request proof of identity before disclosing personal data to you.

To protect against unauthorized access to your account and information, we implement session management, strong authentication requirements, login expiration mechanisms, and the option of using 2-factor authentication for Client Area access. Authentication data is encrypted. As an additional safety measure, we ask you to sign out when you finish using your account and your computer. 

Although we take appropriate technical and organizational measures to maintain the safety and security of your personal data against loss, theft and unauthorized use, access or modification, please note that no transmission of information over the Internet is completely secure. Consequently, please note that we cannot fully guarantee the security of any personal data that you transfer over the Internet to us. 

VIII. Retention periods

Information collected on our Site will only be retained for as long as necessary to fulfill the purpose for which it was collected. In general, we will automatically and securely delete your Client Area account information 2 years after you no longer have any active Services with us. Since we offer a Service for customers worldwide and we need to comply with regulations across the globe in regard to the retention of personal information related to contractual agreements, provision of Services, financial, billing, invoicing operations, tax calculations etc., a versioned copy of your order, payment and billing documentation may be stored for a period of 10 years after the termination of your customer account. Your personal data is deleted automatically by our systems in accordance with these retention periods. 

XI. Your rights 

By visiting the “Owner Profile Details” section in your Client Area, you can access, correct, and delete certain personal data associated with your account. 

In addition, by submitting your inquiry to the email specified in the “Contact information” section of this Policy you may request from us any of the following actions:

  • to confirm whether or not personal data about you is being processed; 
  • to provide you with further details about how we process your personal data;
  • to provide you with a copy of any data which we hold about you; 
  • to withdraw your consent to processing your personal data, where we rely on your consent as a legal basis for processing;
  • to consider any valid objection to the processing of your personal data, including the right to object to processing where we are relying on our legitimate interests as a legal basis for processing;
  • to request an update, rectification or deletion of your personal data, which we process about you; 
  • to restrict the way that we process your personal data;
  • to consider any valid request to transfer (if technically feasible) your personal data to a third-party service provider.

We will review and address your request(s) within one month as of the date of receipt. Please note that if your request is particularly complex or you have made a number of requests, it may take us longer than a month to respond to you. In this case, we will notify you and keep you updated. Please note that we may ask you to provide us with additional information necessary to verify your identity prior to our response. However, in certain circumstances such as to comply with the applicable legislation, we may be unable to honour your request, for which you will be duly notified. 

X. Age Restrictions 

In accordance with UxNitro Terms of Service, our Site and Services are designated for use by individuals who are at least 18 years old. If you are under the age of 18, you must request your parent or guardian to use the Site instead. Should you have evidence that someone under the age of 18 has bought Services and provided their personal data to us, please contact us using the details set out in the “Contact information” section below. If we become aware that we process personal data of a person under the age of 18, we will delete the data and terminate the use of the Services.

XI. Changes to the Privacy Policy

We reserve the right to modify this Policy at any time. If we decide to change our Policy, we will post the updates in the Site and in any other place we deem appropriate, so that you are aware of what personal data we collect, how we use it, and under what circumstances, if any, we disclose it.

If we make material changes to this Policy, we will notify you here, by email, or by means of a notice via our Site, at least ten (10) calendar days before the changes take effect.

UxNitro California Consumer Privacy Act Addendum

This Addendum supplements the information contained in the UxNitro Privacy Policy and applies to Website visitors, Customers, Users, Registrants, End Users, Affiliates and other individuals (incl. households) who are residents of the State of California, USA (“consumer”, “you”, “your”). 

For avoidance of doubt, the term “data subject” used in the Privacy Policy shall correspond to the term “consumer” used herein and the term “personal data” in the Privacy Policy shall be equivalent to the term “personal information” used herein. All other terms which are not explicitly defined in this Addendum shall have the meaning as set forth in the Privacy Policy. 

This Addendum is drafted in compliance with the California Consumer Privacy Act (“CCPA”) and other relevant California privacy laws and its purpose is to provide additional privacy disclosures and to inform you of your additional rights as a California resident.

I. Categories of personal information we collect

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer (“personal information”).

Section I (“Categories of data subjects and types of personal data”) of the Privacy Policy describes in detail what categories of personal information we have collected from consumers within the last twelve (12) months.

II. Sources of personal information collection

Apart from you, being the main source of information we collect about you, we may also collect personal information from publicly accessible sources (e.g. companies trade register, WHOIS, local national list(s) of sanctioned persons) and/or third parties, such as our affiliates, trusted partners, including but not limited to marketing, advertising, security service providers, etc.

III. Purposes for collection of personal information 

The business and commercial purposes for which we collect, use and disclose personal information about consumers is described in detail in Section III (“Purposes of and legal basis for data processing”) of the Privacy Policy.

IV. Sharing of personal information

We may disclose and share personal information to categories of third parties as set forth in Section V (“Sharing of personal data”) of the Privacy Policy. 

V. Sale of personal information 

In the course of provision of our Services we do not sell any personal information related to consumers.

Under the CCPA, “sell,” “selling,” “sale,” or “sold,’’ means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for monetary or other valuable consideration. Therefore, it does not necessarily mean money was exchanged for the transfer of personal information, but the transfer may still be considered a “sale”. 

UxNitro has taken substantial steps to identify whether any of our data sharing arrangements would constitute a “sale” under the CCPA. Due to the complexities and ambiguities in the CCPA, we evaluate some of our third-party relationships periodically.

VI. Consumer rights under the CCPA

The CCPA provides consumers with specific rights with respect to their personal information as follows:

  1. Right to opt-out from sale of personal information

A consumer shall have the right, at any time, to direct UxNitro not to sell the consumer’s personal information (“the right to opt-out”). Such a request of the consumer shall be respected for at least twelve (12) months before requesting that the consumer authorizes again the sale of the consumer’s personal information. In order to process the consumer’s request, UxNitro may use any personal information collected from the consumer in connection with the submission of the consumer’s opt-out request solely for the purposes of complying with the opt-out request.

  1. Right to know request

Pursuant to the CCPA, you have a right to request information about the collection, use, and disclosure of your personal information performed by UxNitro over the preceding twelve (12) months, as well as to ask to provide you with this specific information:

  • Categories and specific pieces of personal information we have collected about you;
  • Categories of sources from which we collect personal information about you;
  • Purposes for collecting, using, or selling personal information;
  • Categories of third parties with which we share personal information;
  • If applicable, categories of personal information sold about you and the categories of third parties to which the personal information was sold, by category or categories of personal information for each third party to which the personal information was sold.

As per the CCPA UxNitro shall take into consideration the following requirements when answering a consumer’s request:

  • The consumer shall place a verifiable consumer request. UxNitro is not obliged to provide information to the consumer if it cannot verify that the consumer making the request is the consumer about whom UxNitro has collected information or is a person authorized by the consumer to act on consumer’s behalf; 
  • UxNitro is obliged to provide the required information no more than twice in 12 (twelve) months; 
  • The provision of information by UxNitro is generally free of charge; 
  • UxNitro shall provide the required information within 45 (forty-five) days of receiving the consumer’s request. The time period to provide the required information may be extended once by an additional 45 (forty-five) days when reasonably necessary, and upon notification to the consumer. The disclosure shall cover the 12-month period preceding the receipt of the verifiable consumer request and shall be made in writing and delivered through the consumer’s Client Area, if the consumer maintains an account with us, or by mail or electronically at the consumer’s option if the consumer does not maintain an account with us, in a readily useable format that allows the consumer to transmit this information from one entity to another without hindrance. UxNitro may require authentication of the consumer that is reasonable in light of the nature of the personal information requested, but shall not require the consumer to create an account in order to make a verifiable consumer request. If the consumer maintains an account with UxNitro, we may require the consumer to submit the request through its Client Area.
    1. Right to delete request – you also have a right to request that we delete a part of or all your personal information, subject to certain exceptions (i.e., when the information is necessary to: complete a transition or provide a service requested by you; debug or repair expected product functionality; detect or investigate cyber threats, etc.). Once we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies.

  1. Right to remain non-discriminated UxNitro shall not discriminate against a consumer because the latter exercised any of the consumer’s rights under the CCPA, including, but not limited to, by:

  • Denying any services to the consumer;
  • Charging different prices or rates for services, including through the use of discounts or other benefits or imposing penalties; 
  • Providing a different level or quality of services to the consumer; 
  • Suggesting that the consumer will receive a different price or rate for services or a different level or quality of services.
